These Terms of Use and Travel Services Agreement (“Terms”) govern your use of https://simplymagicalvacations.com and the travel-planning, booking, advisory, and related services offered by Simply Magical Vacations.
Simply Magical Vacations is based in Denton, Texas and works with affiliated travel advisors located throughout the United States.
In these Terms, “Simply Magical Vacations,” “we,” “us,” and “our” refer to Simply Magical Vacations, doing business as Simply Magical Vacations, together with its owners, authorized representatives, and affiliated travel advisors when acting on behalf of the agency.
“You,” “your,” and “traveler” refer to the person using our website, requesting services, approving a reservation, making a payment, or traveling under a reservation arranged through us.
By using our website, submitting a travel inquiry, requesting a quote, approving a proposal, authorizing a payment, or using our services, you agree to these Terms.
Do not use our website or services if you do not agree to these Terms.
1. About Simply Magical Vacations
Simply Magical Vacations is a travel agency headquartered in Denton, Texas. Our affiliated travel advisors may live and work in different states and may assist travelers located throughout the United States.
Depending on your location and the advisor assisting you, certain additional state-specific registrations, disclosures, consumer protections, or contractual requirements may apply.
The advisor assisting you may communicate under their individual name, business name, or Simply Magical Vacations branding. When an advisor is acting on behalf of Simply Magical Vacations, these Terms apply to the services provided through that advisor.
2. Our Role as a Travel Agency
Simply Magical Vacations provides travel research, planning, advisory, booking, and reservation-assistance services.
We may assist with arrangements including:
- Hotels and resorts
- Cruises
- Vacation packages
- Theme-park vacations
- Airline reservations
- Rental vehicles
- Ground transportation
- Tours and excursions
- Destination weddings
- Honeymoons
- Group travel
- Travel insurance
- Other travel-related products and services
Unless expressly stated otherwise, Simply Magical Vacations does not own, operate, manage, or control the hotels, resorts, airlines, cruise lines, theme parks, tour operators, transportation companies, insurance providers, or other suppliers involved in your trip.
We act as an intermediary between you and independent travel suppliers. The travel services themselves are provided by those suppliers and are subject to their availability, policies, and terms.
3. Affiliated Travel Advisors
Simply Magical Vacations may provide services through affiliated travel advisors located in different states.
Your primary advisor may research options, communicate recommendations, prepare proposals, submit reservations, assist with payments, and provide support before or during your trip.
An affiliated advisor does not have authority to:
- Change a supplier’s terms or policies
- Guarantee supplier performance
- Promise a refund that has not been approved by a supplier
- Waive supplier penalties or fees
- Guarantee room locations, upgrades, amenities, weather, or destination conditions
- Make commitments outside the authority granted by Simply Magical Vacations or the supplier
Statements made by an advisor are subject to the official written terms, confirmations, and policies issued by Simply Magical Vacations and the applicable supplier.
4. Supplier Terms and Conditions
Every travel supplier may maintain its own terms and policies concerning:
- Deposits
- Final payments
- Cancellations
- Refunds
- Changes and rebooking
- Name corrections
- Baggage
- Check-in
- Age restrictions
- Minimum stays
- Resort or destination fees
- Gratuities
- Conduct
- Accessibility
- Documentation
- Health and safety requirements
By approving a reservation, you agree to the applicable supplier’s terms and conditions in addition to these Terms.
Supplier terms may be provided through a proposal, invoice, booking confirmation, supplier website, booking platform, email, or separate agreement.
You are responsible for reviewing all supplier terms before approving or paying for a reservation.
When a supplier’s terms conflict with these Terms regarding a service provided by that supplier, the supplier’s terms will generally control that part of the reservation.
5. Quotes, Pricing, and Availability
All quotes are subject to availability and may change until the reservation has been confirmed and the required payment has been successfully processed.
Travel prices may change without notice because of:
- Supplier pricing
- Limited availability
- Promotional changes
- Taxes and government fees
- Currency fluctuations
- Fuel surcharges
- Seasonal demand
- Changes to the itinerary
- Errors in third-party booking systems
A proposal or quote does not guarantee a price, room, cabin, flight, package, or other travel service.
Simply Magical Vacations is not responsible for a price increase or loss of availability that occurs before the reservation is confirmed.
Unless specifically stated, quoted prices may not include:
- Baggage fees
- Seat-selection fees
- Parking
- Resort or destination fees
- Gratuities
- Optional activities
- Meals
- Local taxes
- Transfers
- Travel insurance
- Personal expenses
We make reasonable efforts to provide accurate pricing. However, we reserve the right to correct an obvious pricing, typographical, supplier, or system error before a reservation is finalized.
6. Proposals and Recommendations
Travel recommendations are based on the information, preferences, dates, budget, and priorities you provide.
You are responsible for confirming that the selected destination, resort, cruise, itinerary, activity, or other travel product is suitable for you and your traveling party.
Travel experiences are subjective. We cannot guarantee that a particular property, destination, room, beach, cruise, restaurant, attraction, or activity will meet every traveler’s personal expectations.
Photographs, descriptions, reviews, ratings, maps, amenities, menus, schedules, and construction information may change or may not reflect current conditions.
7. Planning and Professional Fees
Simply Magical Vacations or an affiliated travel advisor may charge planning, consultation, research, concierge, change, cancellation, group-management, or other professional service fees.
Any applicable fee will be disclosed before it is charged.
Unless otherwise agreed in writing, professional fees paid directly to Simply Magical Vacations compensate the agency and advisor for services performed and are nonrefundable.
These fees are separate from supplier deposits, supplier cancellation penalties, insurance premiums, and other travel expenses.
A supplier refund or trip cancellation does not automatically require Simply Magical Vacations to refund a professional service fee.
8. Traveler Information and Accuracy
You are responsible for providing complete and accurate information for every person included in your reservation.
This may include:
- Full legal names exactly as shown on identification
- Dates of birth
- Citizenship
- Gender or identification information required by suppliers
- Passport information
- Known accessibility needs
- Dietary needs
- Loyalty-program information
- Emergency contact information
- Current telephone numbers and email addresses
- Other information required by a supplier
You must carefully review all proposals, invoices, payment authorizations, confirmations, tickets, and itineraries.
Verify all:
- Traveler names
- Birth dates
- Travel dates
- Destinations
- Flights
- Hotels and resorts
- Room or cabin categories
- Passenger counts
- Package inclusions
- Payment deadlines
Notify your advisor immediately if anything is incorrect.
Suppliers may charge correction fees, and certain reservations may not permit name changes. A name correction may require cancellation and rebooking at the current available price.
Simply Magical Vacations is not responsible for losses, penalties, denied boarding, denied entry, or missed travel resulting from inaccurate or incomplete information supplied by a traveler.
9. Payments and Payment Authorization
By providing payment information or approving a payment, you represent that you are authorized to use the selected payment method.
You authorize Simply Magical Vacations, its host agency when applicable, and the applicable suppliers or payment processors to charge the approved amounts.
Payments may be processed directly by:
- A hotel or resort
- A cruise line
- An airline
- A tour operator
- A vacation-package provider
- An insurance provider
- A host agency
- A third-party payment processor
- Simply Magical Vacations
The name appearing on your account statement may be the supplier’s, host agency’s, or payment processor’s name rather than Simply Magical Vacations.
You are responsible for ensuring that deposits and final payments are completed by the stated deadlines.
A supplier may cancel a reservation if payment is not received on time. Simply Magical Vacations is not responsible for a cancellation resulting from:
- A declined card
- Insufficient funds
- An expired card
- Incorrect payment information
- A card issuer’s fraud controls
- A missed payment deadline
- A traveler’s failure to respond to payment reminders
Payment reminders are provided as a courtesy and do not transfer responsibility for meeting payment deadlines to Simply Magical Vacations.
10. Cancellations, Changes, and Refunds
Cancellations and changes are subject to the policies of the applicable suppliers.
Supplier penalties may increase as the departure date approaches and may equal the full cost of the reservation.
Certain deposits, promotional rates, airline tickets, cruise fares, resort packages, insurance premiums, planning fees, and other travel products may be nonrefundable.
Requests to cancel or change a reservation must be submitted to your advisor in writing.
A cancellation or change is not complete until:
- Your advisor receives the request;
- The request is submitted to the supplier; and
- The supplier confirms the cancellation or change.
You remain responsible for:
- Supplier cancellation penalties
- Change fees
- Fare differences
- Agency professional fees
- Nonrefundable deposits
- Services already provided
Refund eligibility, timing, and payment method are controlled by the supplier and applicable law.
Simply Magical Vacations cannot guarantee that a supplier will approve a refund or issue it within a particular period.
Refunds are generally returned to the original form of payment unless the supplier determines otherwise.
11. Credit-Card Disputes and Chargebacks
Contact your advisor before disputing a travel-related charge so we can help identify the charge and determine whether a supplier refund or cancellation process applies.
Initiating a chargeback does not automatically cancel a reservation or eliminate a valid payment obligation.
You remain responsible for legitimate charges, services authorized, professional fees earned, and supplier penalties properly imposed under the applicable terms.
Simply Magical Vacations may provide booking records, payment authorizations, confirmations, communications, supplier policies, and these Terms to a card issuer or payment processor when responding to a dispute.
Nothing in this section limits any nonwaivable rights you have under applicable law.
12. Travel Insurance
Travel insurance is strongly recommended because many travel arrangements are nonrefundable or subject to significant cancellation penalties.
Depending on the policy purchased, travel insurance may provide benefits for certain covered events involving:
- Trip cancellation
- Trip interruption
- Travel delays
- Illness or injury
- Emergency medical treatment
- Medical evacuation
- Lost or delayed baggage
- Other covered losses
Insurance coverage is governed entirely by the policy’s terms, conditions, limitations, and exclusions.
Simply Magical Vacations and its travel advisors do not decide whether an insurance claim will be approved and cannot guarantee coverage or payment.
You are responsible for reading the insurance policy and directing coverage questions to the insurance provider.
When travel insurance is offered and you decline it, you accept responsibility for losses that could have been eligible for coverage. We may require written confirmation that you accepted or declined insurance.
Simply Magical Vacations is not an insurance company. Insurance products will be offered or facilitated only by persons and entities legally authorized to do so.
13. Passports, Visas, and Travel Documents
Every traveler is responsible for obtaining, verifying, and carrying all required travel documents.
Required documents may include:
- A valid passport
- A visa
- An electronic travel authorization
- Government-issued identification
- Birth certificates
- Documentation for minors
- Parental consent letters
- Custody documents
- Vaccination or health documentation
- Proof of onward travel
- Documents required by an airline, cruise line, destination, or government
Requirements vary based on citizenship, residence, age, destination, transit country, and personal circumstances.
Requirements may change before departure.
You must verify current requirements directly with appropriate government agencies, embassies, consulates, airlines, cruise lines, and other authorities.
Simply Magical Vacations may provide general reminders or informational resources, but those communications are not legal or immigration advice and are not a guarantee that the requirements are complete or current.
We are not responsible for denied boarding, denied entry, missed travel, penalties, or additional expenses resulting from missing, expired, damaged, incorrect, or insufficient documentation.
14. Health and Medical Considerations
Travelers are responsible for determining whether they are physically and medically able to participate in the planned trip and its activities.
You should consult an appropriate healthcare professional regarding personal medical concerns, vaccinations, medications, pregnancy, mobility limitations, or other health considerations.
Simply Magical Vacations does not provide medical advice.
Health and entry requirements may change. Travelers are responsible for reviewing current requirements and carrying any required documentation.
15. Destination Safety and Travel Advisories
Travel involves inherent risks.
Destination conditions may change because of:
- Severe weather
- Crime
- Political instability
- Civil unrest
- Disease outbreaks
- Natural disasters
- Labor disputes
- Transportation interruptions
- Government action
- Local laws and customs
You are responsible for reviewing official travel advisories, destination information, entry requirements, and local conditions before and during travel.
The decision to travel or remain at a destination belongs to the traveler.
Simply Magical Vacations cannot guarantee the safety of any destination or travel activity.
16. Accessibility and Special Requests
Notify your advisor before booking if a traveler has:
- Mobility limitations
- Accessibility requirements
- Allergies
- Dietary restrictions
- Medical equipment
- Service-animal requirements
- Pregnancy-related considerations
- Other special needs
We will make reasonable efforts to communicate requests to suppliers. However, a request is not guaranteed unless the supplier confirms it.
Travelers are responsible for determining whether a destination, resort, cruise ship, vehicle, excursion, attraction, or activity is appropriate for their needs.
Simply Magical Vacations is not responsible when a supplier cannot fulfill an unconfirmed request.
17. Minor Travelers
Information for a minor must be provided and approved by a parent, legal guardian, or authorized adult.
The responsible adult must obtain all documents and permissions required for the minor’s travel.
These may include:
- Passports
- Visas
- Birth certificates
- Custody documentation
- Notarized consent letters
- Airline forms
- Cruise-line documentation
Age and supervision requirements vary by destination and supplier.
18. Groups and Multiple Travelers
The person requesting or coordinating a group reservation represents that they are authorized to communicate information and booking decisions on behalf of the travelers included in the request.
Each adult traveler remains responsible for reviewing and accepting the terms applicable to their reservation.
The group organizer is responsible for accurately communicating deadlines, policies, itinerary information, and required actions to the other travelers unless Simply Magical Vacations has agreed otherwise in writing.
Simply Magical Vacations is not responsible for disputes between members of a traveling party.
19. Supplier Changes and Travel Disruptions
Suppliers may change or cancel:
- Flights
- Schedules
- Routes
- Cruise ports
- Hotels
- Room assignments
- Activities
- Entertainment
- Restaurants
- Amenities
- Transportation
- Other itinerary components
We will make reasonable efforts to communicate changes and help identify available alternatives.
However, Simply Magical Vacations does not control supplier decisions and cannot guarantee a particular refund, credit, replacement, or other remedy.
Additional expenses resulting from delays, cancellations, missed connections, schedule changes, or disruptions remain the traveler’s responsibility unless paid by the supplier, required by law, or covered by insurance.
20. Events Beyond Our Control
Simply Magical Vacations is not responsible for a delay, cancellation, change, loss, injury, or expense caused by events outside our reasonable control.
These events may include:
- Hurricanes or severe weather
- Floods, fires, or earthquakes
- Epidemics or pandemics
- War or terrorism
- Civil unrest
- Government actions
- Border closures
- Labor strikes
- Supplier insolvency
- Mechanical failures
- Air-traffic restrictions
- Utility outages
- Technology failures
- Communication disruptions
- Acts or omissions of independent suppliers
- Other force-majeure events
Supplier policies, insurance coverage, and applicable law will determine whether refunds, credits, replacements, or other remedies are available.
21. Client Conduct
Travelers must comply with the conduct, safety, and security rules established by suppliers and destinations.
A supplier may refuse service, remove a traveler, or cancel the remaining portion of a trip because of behavior it considers unsafe, disruptive, threatening, unlawful, abusive, or inappropriate.
Simply Magical Vacations is not responsible for refunds, costs, or losses resulting from a traveler’s behavior or failure to follow supplier rules.
We may discontinue services when a client engages in harassment, threats, abuse, fraud, unlawful conduct, or repeated inappropriate communication toward an advisor or representative.
22. Website Information
We make reasonable efforts to maintain accurate website information. However, travel information changes frequently.
Website content may contain errors, omissions, or outdated information.
Content on the website is provided for general informational purposes and does not constitute:
- A guaranteed price
- A confirmed reservation
- Legal advice
- Medical advice
- Immigration advice
- Safety advice
- A guarantee of supplier performance
A reservation is not confirmed until an official confirmation has been issued and required payments have been processed.

Supplier names, photographs, trademarks, and logos belong to their respective owners. References to suppliers do not indicate ownership of or an exclusive relationship with those suppliers.

Electronic approvals, typed signatures, payment authorizations, and checkbox selections may be treated as your agreement and authorization to the fullest extent permitted by law.

28. Disclaimer of Warranties
To the fullest extent permitted by law, our website and travel-advisory services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Simply Magical Vacations, its owners, affiliated advisors, contractors, agents, and representatives will not be liable for the acts, errors, omissions, negligence, representations, breaches, delays, cancellations, or failures of independent travel suppliers or other third parties.
Simply Magical Vacations will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
- Lost enjoyment
- Lost income
- Missed travel
- Missed connections
- Additional accommodation costs
- Additional transportation costs
- Emotional distress
- Loss of personal property
Where liability cannot legally be excluded, the total liability of Simply Magical Vacations will be limited to the professional fees paid directly to Simply Magical Vacations for the specific services giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited, including liability resulting from our gross negligence, willful misconduct, or fraud.
30. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Simply Magical Vacations, its owners, affiliated advisors, contractors, agents, and representatives from claims, damages, liabilities, losses, and reasonable expenses arising from:
- Your violation of these Terms
- False or inaccurate information you provide
- Your violation of applicable law
- Your misuse of the website
- Your unauthorized use of another person’s payment method
- The conduct of you or a member of your traveling party
This provision does not require you to indemnify Simply Magical Vacations for its own gross negligence, willful misconduct, or fraud.
31. State-Specific Requirements and Disclosures
Simply Magical Vacations is based in Denton, Texas and works with affiliated advisors and travelers throughout the United States.
Certain states may impose registration, licensing, disclosure, trust-account, bonding, cancellation, or other requirements on travel agencies, sellers of travel, or individual advisors.
When a state-specific law applies, Simply Magical Vacations and its affiliated advisors will provide any disclosures required by that law.
Applicable registration information may include:
Registration as a seller of travel does not constitute approval or endorsement by a state.
Nothing in these Terms is intended to waive or limit a consumer protection or other legal right that cannot be waived under the laws applicable to you.
32. Complaints and Good-Faith Resolution
Contact your advisor promptly if you experience a problem with your reservation or travel services.
Reporting an issue during the trip may provide the supplier or advisor with an opportunity to address it before the trip ends.
Before filing a lawsuit, the parties agree to make a reasonable, good-faith effort to resolve the dispute through direct written communication.

33. Governing Law and Venue
Simply Magical Vacations is headquartered in Denton, Texas.
Except where applicable law requires otherwise, these Terms and disputes arising from them will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Except where applicable law requires otherwise, a legal proceeding arising from these Terms or services provided by Simply Magical Vacations must be brought in a court of competent jurisdiction located in Denton County, Texas.
This section does not eliminate or restrict any nonwaivable legal protections available to a traveler under the laws of the state where the traveler resides or where an affiliated advisor conducts business.
34. Severability
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
The invalid provision will be interpreted or modified as closely as legally permitted to accomplish its intended purpose.
35. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision later.
36. Assignment
You may not assign your rights or obligations under these Terms without our written consent.
Simply Magical Vacations may assign these Terms in connection with a sale, merger, restructuring, transfer of ownership, or similar business transaction.
37. Entire Agreement
These Terms, together with the following documents when applicable, constitute the agreement relating to our website and travel services:

- Your travel proposal
- Your invoice
- Payment authorizations
- Supplier terms and conditions
- Insurance documents
- State-specific disclosures
- Any separate written service agreement
If a separately signed agreement directly conflicts with these Terms, the separately signed agreement will control for the subject it specifically addresses.
38. Changes to These Terms
We may update these Terms to reflect changes to our services, suppliers, business practices, technology, or legal obligations.
Updated Terms will be posted on this page with a revised effective date.
Changes will apply prospectively and will not alter the terms of a previously confirmed reservation unless permitted by the applicable agreement, supplier terms, or law.
